Terms of Service

1. Acceptance of Terms
By accessing or using the SeatWatch platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and SeatWatch.
We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
2. Description of Service
SeatWatch is an automated restaurant reservation monitoring and booking platform. The Service monitors the Resy platform for reservation availability on your behalf and attempts to book reservations automatically when matching availability is detected.
The Service operates by periodically checking Resy for available reservations that match your specified criteria, including restaurant, date, party size, and time preferences. When a match is found, the Service attempts to complete the booking using your provided Resy account credentials.
3. Account Registration
To use the Service, you must create an account through our authentication provider, Clerk. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
Each user is permitted one account. You may not create multiple accounts, share your account credentials with others, or allow others to access the Service through your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Resy Account Credentials
To enable automated booking, you must provide your Resy account login credentials. By providing these credentials, you acknowledge and agree to the following:
- Your Resy credentials are encrypted using AES-256-GCM encryption and stored securely in our database. Each credential record uses a unique initialization vector (IV).
- Your credentials are decrypted only at the time of booking execution and are held in worker memory only for the duration of the booking attempt.
- Your Resy credentials are used solely for the purpose of monitoring availability and executing reservation bookings on your behalf.
- You are responsible for ensuring that your use of the Service complies with Resy's own terms of service and acceptable use policies.
- SeatWatch is not responsible for any actions taken by Resy against your account, including but not limited to account suspension or termination.
5. Subscription Plans and Billing
SeatWatch offers the following subscription tiers:
- Free: Limited to one active reservation request at a time. Sniping mode only.
- Pro ($25/month): Up to five active reservation requests with sniping and monitoring modes, SMS and email notifications.
- Elite ($60/month): Unlimited active reservation requests with sniping and monitoring modes, SMS and email notifications, and priority support.
- Day Pass ($19): Full Elite-level access for 48 hours from the time of purchase.
All payments are processed securely through Stripe. Pro and Elite subscriptions automatically renew each billing cycle unless cancelled. You may cancel your subscription at any time through your account settings; access will continue until the end of the current billing period.
Day Pass purchases are non-refundable. Day Pass access expires automatically 48 hours after purchase, at which point your account reverts to the Free tier.
6. Acceptable Use
The Service is intended solely for personal, non-commercial use to manage your own restaurant reservations. You may not use the Service on behalf of others, for commercial purposes, or to gain an unfair advantage over other diners.
You agree not to use the Service to:
- Abuse, overload, or otherwise interfere with the Service or third-party platforms, including Resy.
- Circumvent or attempt to circumvent rate limiting, access controls, or other technical measures implemented by the Service or Resy.
- Resell, transfer, broker, or otherwise distribute reservations obtained through the Service. Selling or offering to sell restaurant reservations may violate applicable law, including the New York City Restaurant Reservation Anti-Piracy Act (effective February 2025), which makes it unlawful to sell or offer to sell restaurant reservations to which the seller has no right of use.
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Create multiple accounts to circumvent plan limits or other restrictions.
We reserve the right to suspend or terminate your account without refund if we determine, in our sole discretion, that you have violated these acceptable use policies. Accounts found to be involved in the resale or brokering of reservations will be immediately terminated.
7. Intellectual Property
The Service, including its design, features, code, and content, is the property of SeatWatch and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
"SeatWatch" and associated logos and branding are trademarks of SeatWatch. You may not use these marks without our prior written permission.
8. Limitation of Liability
To the fullest extent permitted by applicable law:
- SeatWatch does not guarantee the availability of any reservation. Restaurant availability is determined by Resy and the restaurants themselves, and is subject to change at any time.
- The Resy API is a third-party service that may change, become unavailable, or restrict access at any time. SeatWatch is not responsible for disruptions caused by changes to the Resy platform.
- SeatWatch is not affiliated with, endorsed by, or officially connected to Resy or American Express in any way.
- In no event shall SeatWatch be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
- Our total liability for any claim arising from the Service shall not exceed the amount you paid to SeatWatch in the twelve months preceding the claim.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
SeatWatch does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. You use the Service at your own risk.
10. Termination
Either party may terminate this agreement at any time. You may terminate your account by contacting us or through your account settings. We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice.
Upon account closure, we will delete your data, including your encrypted Resy credentials, in accordance with our Privacy Policy. Any outstanding billing obligations will remain due.
11. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or through the Service.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
